Lawrence Dority, 29, made his first court appearance Tuesday, after he allegedly shot and killed Payne on Monday, according to WFTV. Dority has been charged with first-degree murder.

According to an arrest warrant obtained by WFTV, Payne was parked outside of Dority’s home before the shooting. Dority told deputies that he felt threatened by Payne and was intimidated by his size. He also told them that he thought Payne had a gun on him so he went inside his home and grabbed a weapon himself. He then walked outside and shot Payne. Witnesses told deputies that Payne was not threatening Dority. Officials also confirmed that Payne was not armed at the time. Dority stayed at the scene until deputies arrived.

Dority pleaded not guilty Tuesday morning to his recommended charges of first-degree murder, according to the Detroit Free Press.
