Florence Kelly was killed in the Nov. 7 crash in Dallas, but just this week, police announced that they had charged the preteen with murder, KDFW reported.

Witnesses said the driver of a 2005 Toyota Avalon had run a stop sign and hit Kelly’s car. They told police that the driver appeared to be a teen.

Police said the driver and several passengers got out of the wrecked car and ran, leaving behind a 13-year-old girl pinned inside the vehicle, WFAA reported.

The girl suffered serious injuries and was hospitalized, KXAS reported.

Bystanders tried to stop the trio but were unable to catch them.

Kelly was transported to a local hospital where she died, KXAS reported.

The 12-year-old driver’s name has not been released because of his age — he cannot be tried as an adult. Only teens from age 14 to 17 can be considered adults in capital murder or first-degree felony cases.

Police said the investigation is still ongoing, WFAA reported.
