A Day To Remember is suing Victory Records for unpaid royalties. Here's a statement from the label pointing the finger in the other direction.
Recent reports of claims [...] have misleadingly stated that the principal issue in the case concerns the payment of royalties. The lawsuit, filed shortly after the band hired new management, is really about the band's refusal to fulfill their 5-album contractual commitment to Victory and their newfound desire to move to a major label. Recycled and often apocryphal stories of misguided and unsuccessful attempts by a few Victory bands to jump ship from the label that put them on the map have one common truthful thread; they always end badly for the band.
Victory continues to honor its commitment by placing its significant resources behind the band's current album. The band has enjoyed the benefits of the hundreds of thousands of dollars in record royalties generated from their album sales, which Victory accounts for in full compliance with its contract. Victory's job remains the same- work hard, sell records and abide by our agreements.
A Day To Remember will hit the road opening for Rise Against early next year, and Rise is very excited to have them.

Foo Fighters performed in New Zealand recently - and literally shook the earth. A seismologist monitoring at a nearby research facility said, “The cause of the shaking is most likely the weight of the 50,000 fans dancing" as the band took the stage." Multiple tremors were reported during the show, but the biggest coincided with the band taking the stage.
Mumford & Sons are almost done with their follow-up to Sigh No More. Bassist Ted Dwayne describes the new material as " doom folk, kind of like Black Sabbath meets Nick Drake.”
Shinedown has a new album almost ready for a spring release. They'll leak a song just after the first of the year. Guitarist Zach Myers explained singer Brent Smith's creative process, "We aren't a band that goes into the studio and makes a record in six weeks. 'The Sound Of Madness' took 24 months to write. Brent has this weird thing when we're writing, we go into the studio, and there are no clocks around; there are no calendars on the wall. He doesn't like to have a time limit on being creative."
The Used will release their next albumVulnerable on their own imprint in 2012. Singer Bert McCracken says the record sounds both like their first album and the future.
The Shins will drop Port Of Morrowthis March. It'll be the band's first album in five years. I heard "Simple Song" the other day, and unlike that overrated song from that movie Garden State, my life did change a little. Shins mainman James Mercer was recently active with Danger Mouse in the band Broken Bells.
M83 is a French dance-pop project garnering lots of hype right now. Below is the video for "Midnight City." You like?
